Peripheral Products Purchased

In Store or On line, Products Designated OEM:
Products purchased that are OEM (not in a retail box, but lose or in a "white-box") are not returnable. All sales are final.
On line purchases are not subject to returns and we will not accept an RMA (Return Merchandise Authorization) request. If the product is defective we may cross ship a new component for a defective one. If the defective product, now in exchange mode (cross shipped), is not returned to us within 10 days of original purchase, we have the option to charge for the product cross shipped. We will not accept the defective part past it's deadline.

Products Designated Retail Box:
Retail Boxed Products are returnable for a full and complete refund within 10 days of purchase if they are still in their ORIGINAL UNOPENED container (box, bag, etc.). After 10 days, but before 30 days from the date of purchase, an unopened product may be returned for a partial refund or store credit. If the product container has been opened, the product is returned after 30 days, or the product used in any way, we will not accept the product back for refund.

Software:
We do not accept software back for refund under ANY conditions. If the product is defective we will assist you in getting a replacement from the manufacturer. If the product is the wrong product for your job it is not our responsibility to exchange or refund your purchase price. Under most license agreements we may not intervene on your behalf. As the user you must return the product to the manufacturer.


Warranty & Claims for BTO Diablo Computers

General:
The BTO Diablo Computer Warranty covers Mechanical or Electrical defects for each of the components (hardware) in your BTO Diablo Computer (AKA Diablo Computer and CUSA) computer. We will repair, replace or substitute the defective part at our cost FOB Clayton, CA. during the warranty period specified on your invoice. Our coverage is limited to the cost of the component(s) plus our time to install and test the replacement part. You are responsible for all other costs, such as shipping & insurance, associated with getting the computer to and from our repair facility. If you ship you must have insurance in adequate amounts to cover the cost of replacement if lost or damaged. No implied warranty for merchantability or specific use.

Warranty & Claims for Refurbished Computers & Notebooks

General:
The CUSA Computer Warranty covers Mechanical or Electrical defects for each of the components (hardware) in your BTO Diablo Computer (AKA Diablo Computer and CUSA) computer for the period specified in the advertisement or written in the invoice, with the invoice superseding all advertisements. We will repair, replace or substitute the defective part at our cost FOB Clayton, CA. during the warranty period specified on your invoice. Our coverage is limited to the cost of the component(s) plus our time to install and test the replacement part. You are responsible for all other costs, such as shipping & insurance, associated with getting the computer to and from our repair facility. If you ship you must have insurance in adequate amounts to cover the cost of replacement if lost or damaged. No implied warranty for merchantability or specific use.

For New Diablo Computer Systems w/ No Specified Warranty Information:
An invoice created with an unspecified warranty period automatically creates a 30 day warranty on the product. This period starts from the time of placement of the order, which is considered the date of purchase unless otherwise specified, to the end of 30 days. The warranty can be extended according to modifications on your invoice/order. Keep a copy for your records.

For Application Software:
There is no application/utility software warranty expressed or implied. Due to the nature of software, it’s method of registration, activation and embedded product ID keys it can not be returned to BTO Diablo Computer once it is opened, used or received by the customer. The customer must seek repairs or replacement directly from the manufacturer. The manufacturer may refuse replacement or refund, or may require an additional fee for a new copy or Product ID key.

Data Not Covered:
You are responsible for data and/or program(s) losses as a result of any hardware failure and reloading or restoring the Operating System (O/S such as Windows 98, XP, etc.) or the reloading of application programs corrupted during the hardware failure process.

Not Covered:
This warranty does not cover failure due to abuse, loss or breakage which includes shipping, improper setup or component attachments, acts of God, failure caused by the power spikes, surges or outages by the Power Company as evidenced by power supply failure or blown or shorted components on the motherboard, or failure caused by third party components. This includes, but not limited to, earthquake, flood, electrical storms, power or transformer failure and other such acts, which are unforeseeable, any component supplied to Diablo Computer by the customer or damaged caused to components installed by Diablo Computer by customer supplied components.

Insurance Coverage/Claims:
Loss or breakage in shipping must be referred to the respective carrier for reimbursement under the insurance claim. All computers are tested and certified in excellent working condition prior to shipping. A component which doesn’t work has been damaged in shipping.

Shipping:
Do not send a damaged shipment back to CUSA or BTO Diablo Computer without a RMA request form authorized; we can not accept it. It will void your warranty and it may void the shipping insurance which is placed on the shipment in your behalf. You must contact the shipping company and make an insurance claim.

Repairs:
To claim a warranty repair you must print and follow the instructions under Return Merchandise Authorization “RMA”. An RMA request form and number must be included with any returned items. In addition, we may fix your Diablo Computer for failures not under warranty, however applicable charges will apply. See RMA procedures on our web page.

Restocking:
If component(s) are restocked their will be a restocking fee of 20% of the original sales price. You must follow the RMA procedures.

Legal For legal purpose all parties agree the transaction occurred in Clayton, California 94517 where the sale is final. In a dispute to enforce the scope of this warranty the prevailing party is entitled to court approved costs and expenses.
